This Agreement between (“FMB Member”) and Floatmybiz (“Floatm”) of Muskegon, Michigan, for good and valuable consideration, is set forth as follows:

FMB Member has read and agrees to the terms and conditions of this agreement and the Terms of Use set forth on Floatm’s website, regarding one or more systems as described below.

This Agreement shall remain in effect for an initial term of 6 months commencing upon installation of such system as defined herein. Following the initial term, this agreement will automatically renew for the same months stated above, unless either party provides written notice to terminate notice no later than sixty (60) days from the renewal date of the Agreement.

In the event that you would like to terminate this agreement early, a 50% fee charge of the remaining term of the FMB Member’s agreement, will be assessed.

The inclusion of any advertisements or uploads by FMB Members are subject to the terms and conditions of the Terms of Use on Floatm’s website. Abuse of any copyright or other law in FMB Member attempts to upload advertisements on Floatm’s network may cause Floatm to immediately terminate this Agreement and remove its system and equipment from FMB Member.

Late Payment

Late Payment Penalty. With respect to the unpaid amount of any invoice not paid in full within 30 days of receipt, a charge of 1.5% will be added to the bill for every 30 days it is late. After 60 days Floatm has the right to discontinue services until the amount owed, including late payment fees, is paid in full.

This Agreement is governed by the laws of the State of Michigan. Floatm reserves all rights in law and equity. IN NO EVENT SHALL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY BREACH OF THIS AGREEMENT OR RESULTING DIRECTLY OR INDIRECTLY, OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY THERE OF.

This Agreement is binding upon the heirs, successors and assigns of the FMB Member.

The signatory below warrants that they are authorized on behalf of the FMB Member, to bind the FMB Member and to enter into this Agreement.
